These Terms & Conditions ("Terms") govern your access to and use of the SurpriseByte website, application, and related services to create and publish bespoke digital gifts (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or publish a gift. By using the Services you represent that you meet this requirement and that the information you provide is accurate.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
Creating, editing, and previewing digital gifts is free. Publishing a gift — making its shareable link live — costs a one-time fee of US$9.99 per website. There is no subscription and no recurring charge. We may modify or discontinue features of the Services, but published gift links are addressed in Section 11.
You retain ownership of the text, audio, video, images, and other media you submit ("User Content"). You grant SurpriseByte a limited, worldwide, non-exclusive license to host, store, process, reproduce, and deliver your User Content solely to provide and operate the Services, including generating and delivering your digital gift. This license ends when the content is deleted, except for residual backup copies as described in our Privacy Policy. We do not use your private audio, video, or photo files to train AI models or for public marketing without your explicit, separate consent.
You agree not to use the Services to create, upload, or publish content that is unlawful, infringing, defamatory, harassing, or that violates the privacy or rights of others. You must have the consent of any individuals featured in media you upload. You must not upload sensitive personal information, confidential data, or financial details into the gifts you create. You must not attempt to disrupt, reverse engineer, or gain unauthorized access to the Services.
The publishing fee is US$9.99 per website, charged once at the time you publish. Prices are stated in US dollars and are exclusive of any applicable taxes, which may be added at checkout. Payment is processed by third-party payment providers; by publishing you authorize the applicable charge.
Refunds for the publishing fee are governed by our Refund Policy, which forms part of these Terms.
When you publish a gift, its content becomes accessible to anyone who has the link. You are solely responsible for the content you publish and share, for ensuring it complies with applicable laws, and for obtaining the consent of any individuals featured. Do not include confidential or sensitive personal information in published gifts.
The Services, including their software, design, and branding, are owned by SurpriseByte and protected by intellectual property laws. These Terms do not grant you any rights in the Services other than the limited right to use them as permitted here.
A published gift link is intended to remain accessible and is not contingent on any ongoing payment. Receiving a gift never costs the recipient anything. We may remove a published gift only where required by law, to address abuse or a policy violation, or as otherwise described in our Privacy Policy's Data Retention section.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, SurpriseByte will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, arising from your use of the Services. Our total aggregate liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months preceding the claim.
You may stop using the Services at any time and may close your account as described in our Privacy Policy. We may suspend or terminate your access if you breach these Terms or use the Services unlawfully.
These Terms are governed by the laws applicable at SurpriseByte's principal place of business, without regard to conflict-of-law principles. Mandatory consumer protections in your country of residence still apply where required by law.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date above. If we make material changes, we will provide notice through the Services or by other appropriate means. Your continued use of the Services after an update indicates your acceptance of the revised Terms.

How refunds work for the one-time website publishing fee.

This Refund Policy applies to the one-time US$9.99 fee charged when you publish a digital gift website on SurpriseByte. Creating, editing, and previewing gifts is free, so there is nothing to refund for those activities. This policy forms part of our Terms & Conditions.
Publishing is a digital service that is delivered immediately: as soon as your payment is processed, your gift link goes live and becomes shareable. Because the service is rendered at the moment of publishing, the publishing fee is generally non-refundable.
We may, at our discretion, issue a refund of the publishing fee if all of the following apply:

Approved refunds are issued to the original payment method. Depending on your payment provider, it may take up to 5–10 business days for the refund to appear on your statement.
We may update this Refund Policy from time to time. When we do, we will update the "Last Updated" date above. Your continued use of the Services after an update indicates your acceptance of the revised policy.
